Job Description: 
As lead of the Commercial department, focusing on contract negotiation and management. The successful incumbent will be required to manage and drive all matters related to the commercial activities of the Company, specifically the development of contracts, contracting arrangements and managing contracts that enable the business to achieve its operational and strategic objectives. The Commercial Manager will report directly in to the General Manager and will perform ad hoc duties for him/her if required.


  • Lead/oversee complex and high value contract negotiations which result in positive impacts to the operating margin
  • Ensure the execution of commodities on site against agreed contract conditions and Service Level Agreements with Key Performance Indicators
  • Strong working knowledge of metrics to monitor performance of commercial activities, reporting results to senior management
  • Strategic development and critical thinking skills needed to assist in setting financial targets, developing budgets, and monitoring compliance
  • Approves the appointment of every contractor, and ensures that payments are properly approved
  • In conjunction with contract originator, ensure that contracts remain valid and are reviewed prior to renewal
  • Conduct market research to continually assess cost competitiveness and market trends to manage existing supplier contracts
  • Present in conjunction with Supply Chain all price increases in respect of long term and high value Contracts for approval
  • Ensures that contractors/suppliers are kept fully aware of their contractual and legal obligations
  • Advises on methods to create a smooth transition by resolving / escalating issues
  • Assign, supervise, and review the work performance of subordinates
  • Develop and coach team members
  • Facilitate staff development by implementing training programs and undertake performance appraisals to the required schedules

Requirements: Qualification and Skill

  • B-degree in Business/Contract Law or similar, additional commerce qualification advantageous
  • At least 10 years’ experience in contract and commercial contracting of which 3 must be at a senior level
  • At least 5 – 10 years’ experience in the mining industry
  • Previous experience in the DRC desirable or exposure to other Central African countries
  • Good working knowledge of international standards and preferably, national DRC legislation
  • Strong command of SAP and other relevant software
